These Terms of Use apply to your access to and use of spareroom.net.au and any related products or services we make available through the website.

By using SpareRoom you agree to these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. When we do, the updated version will be published on this page. Continued use of the Service after an update takes effect constitutes acceptance of the revised Terms.

SpareRoom provides a platform where people can advertise rooms, search for rooms, create profiles, and communicate with each other. SpareRoom is not a real estate agent, tenancy manager, guarantor, or party to any agreement between members.

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, immediate delivery of messages, or that every listing, profile, or enquiry will be accurate, complete, or suitable for your needs.

Fees

SpareRoom may offer free and paid features. Any fees, upgrades, promotional options, or pricing terms will be displayed separately where relevant.

Any payment, bond, rent, utility contribution, or other financial arrangement between members is agreed directly between those members. SpareRoom is not responsible for those arrangements unless explicitly stated otherwise.

We reserve the right to introduce, change, or remove fees for features at any time.

User obligations

  1. You must provide accurate and up-to-date information when creating an account or listing.
  2. You must be at least 18 years old to register and use the Service.
  3. You must not post false, misleading, unlawful, discriminatory, abusive, obscene, or infringing content.
  4. You must not use SpareRoom to harvest data, spam members, or advertise unrelated products or services.
  5. You must not interfere with, damage, or attempt to gain unauthorised access to the website, member accounts, or connected systems.
  6. We may remove content, suspend accounts, or restrict access where we reasonably believe these Terms or our policies have been breached.

Listings and member interactions

Members are responsible for the content they publish and for the decisions they make when contacting, meeting, or entering into arrangements with other members.

  1. Advertisers must ensure their listing descriptions, prices, photos, and availability are materially accurate.
  2. Seekers must conduct their own checks before committing to a room or household.
  3. Members should use reasonable caution when sharing personal information, arranging inspections, or meeting offline.
  4. Any tenancy, occupancy, boarding, or house-sharing arrangement is solely between the parties involved.

Business changes

If SpareRoom is involved in a merger, acquisition, sale of assets, or similar transaction, information associated with the Service may be transferred as part of that transaction, subject to applicable law.

Privacy policy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and disclose personal information.

Disclaimer

You expressly understand and agree that your use of SpareRoom is at your sole risk.

  1. We do not warrant that the Service will be uninterrupted, timely, secure, or error free.
  2. We do not warrant that listings, profiles, or communications on the site will always be accurate, reliable, or suitable.
  3. We do not guarantee that any room, property, advertiser, or seeker will meet your expectations.
  4. No advice or information obtained through SpareRoom creates any warranty not expressly stated in these Terms.

Limitation of liability

To the maximum extent permitted by law, SpareRoom is not liable for losses arising out of or connected with your use of the Service, your dealings with other members, or your inability to access the Service.

  1. Any indirect, incidental, special, consequential, or exemplary loss.
  2. Any loss of revenue, profits, business, contracts, or opportunities.
  3. Any loss of data, goodwill, or reputation.
  4. Any damage or dispute arising from interactions, inspections, arrangements, or agreements between members.

Nothing in these Terms excludes rights or remedies that cannot be excluded under applicable law.
